1. Introduction


The www.sail-a-way.gr website, (the “Site”) is owned and operated by Sail A Way M.C.P.Y. incorporated in Patras, Greece. (“Sail A Way” , “we” , “us” or “our”).

These terms and conditions together with the Privacy Policy, govern the relationship between Sail A Way and any party which uses the Site.

By using or accessing the Site you acknowledge that you agree to and are subject to the Terms and Conditions as well as our Privacy Policy. If you do not fully agree with our Privacy Policy or with our Terms and Conditions, you are not authorised to use the Site.

2. Booking

2.1. The person making the booking (the "Lead Charterer") must be 18 years old or over and possess the legal capacity and authority to make the booking and accepts these booking conditions on behalf of everyone in their party. The Lead Charterer must hold a sailing licence, valid at the time of the booking as well as for the duration of the booked dates. The original sailing licence must be presented at check-in. We reserve the right to refuse check-in if the Lead Charterer cannot procure the original sailing licence or presents only a photocopy of said licence.  

2.2. Whether you book alone or as a group, we will only deal with the Lead Charterer in all subsequent correspondence, including changes, amendments and cancellations. The Lead Charterer is responsible for ensuring the accuracy of the personal details or any other information supplied in respect of all passengers and for passing on any information regarding the booking or any changes made in relation thereto to all passengers, including but not limited to information on schedule changes of booking confirmations. Unaccompanied passengers under the age of 18 years need a letter of consent to travel alone from a parent or legal guardian. The minimum age for an unaccompanied passenger is 18 years of age on the date of departure.

2.3. We will consider special requests when you book. We will tell you whether there is a charge for the request. We can only guarantee requests for which there is a charge, or those that are confirmed in writing. It is your responsibility to advise us of any special requirements. We regret we cannot accept any booking which is conditional upon the fulfillment of a particular request.

2.4. Notwithstanding the sailboat rental costs, an additional fixed amount will be credited as a security deposit at the time of your booking if you choose a bareboat charter. The security deposit will be returned to you at check-out after verification that no damages were incurred on the booked sailboat or on third parties’ boats.

3. Changes and cancellations

Your right to a refund is limited. You will be able to cancel your booking within seven (7) days of receipt of the booking confirmation, providing that your booking period is not due to begin within forty-five (45) days’ of the booking confirmation. In the event that you choose to exercise this right of cancellation, no fees will be payable by you.

4. Use of the sailboat

4.1. You shall ensure that the behaviour of all guests shall not cause any nuisance to any person, including but not limited to the skipper of the sailboat or Sail A Way owners. You shall comply, with the laws and regulations of Greece during the course of your booking. You shall ensure that no illegal items are brought aboard the sailboat, or may be brought aboard during your Booking.

4.2. In the event that any guest infringes any of these terms, or undertakes any illegal activity whatsoever under the local laws and regulations, Sail A Way may, forthwith on notice to you, terminate your Booking early and without refund of any kind.

4.3. If any guest commits any offence contrary to the local laws and regulations during your Booking which results in the captain or any member of the crew of the sailboat being detained, fined or imprisoned, or the sailboat being detained, arrested, seized or fined, you shall indemnify Sail A Way against any and all loss, damage or expense incurred as a result.

5. Insurance

5.1 Sail A Way does not offer or supply travel insurance of any kind, and it is your sole responsibility to ensure that you have taken out adequate travel insurance for your booking, taking into account the potentially arduous nature of sailing a sailboat in the area which you have chosen for you booking. We do not accept any liability whatsoever in the event that you sustain any loss or damage as a result of not having in place adequate travel insurance for your booking.

5.2 All sailboats are properly insured according to local laws covering third-party liability.

5.3 Any damages incurred to the booked sailboat or to other sailboats as a result of your actions or inactions during a bareboat charter will be paid for by the security deposit. If the amount of the damage exceeds that of the security deposit, the remainder will be covered by the existent insurance policy of the sailboat. If the amount the damage is inferior to the security deposit, the remaining amount will be returned to you after the compensation for the damage incurred. 

6. Warranties

To the maximum extent permitted by applicable law, Sail A Way hereby exclude all warranties of any kind, either express or implied, including but not limited to any (if any) implied warranties fitness for a particular purpose and any warranties arising in law.

7. Intellectual property rights

The Site contains copyrighted material and tradenames including, but not limited to, texts, software, photos and graphics, and may in future include video, graphics and sound (“Content”). The Content is protected by copyright law, registered and unregistered trademarks and other intellectual property rights. Sail A Way owns the copyright and other intellectual property rights in such Content unless otherwise specified.

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content in whole or in part.

8. Use of the website

The Site’s stated purpose is oriented around providing sailing information as well as a booking process for sailboat vacation in Greece. Any use of the site that exceeds that purpose causing intended damages or malfunctions is against the use policy of the Site. Sail A Way reserves the right to use all available legal tools provided by Greek law against such actions. 

9. Jurisdiction

Any dispute hereunder, which the Parties have not been able to settle amicably, shall be decided in accordance with Greek law.
